Marine Vet Daniel Penny Found Not Guilty Of Criminal Negligent Homicide

In March of 2023, the Marine veteran Daniel Penny was arrested in the death of homeless man Jordan Neely. Penny had stepped up to protect a subway train of passengers after Neely began acting erratically.

Since there was no way for anyone to get off the moving subway car, Penny stepped up and put Neely in a chokehold. Sadly, Neely eventually passed away.

Many felt that Penny is a hero who never should have been arrested. They believe that he saved his fellow passengers. Since Penny is white and Neely was black, however, the woke left has been pushing for Penny to be sent to prison.

On Monday, Penny learned his fate as the verdict came in.

Daniel Penny has been found not guilty of criminally negligent homicide for the death of Jordan Neely by the jury on Monday.

Penny, a 25-year-old former Marine, put Neely, a 30-year-old homeless man, in a minuteslong chokehold after Neely boarded a subway car acting erratically in May 2023, according to officials. Neely entered a subway car on an uptown F train at the Second Avenue stop, and was described by witnesses as yelling and moving erratically when Penny put Neely in a chokehold, officials said.

The case captured national attention, putting a spotlight on homelessness, severe mental illness, safety, and race. The jury deliberated for more than 24 hours across five days before reaching the verdict.

Afterward, Manhattan District Attorney Alvin Bragg thanked the jury. He also pledged to respect the verdict that they handed down.

“The jury carefully deliberated for four days,” Bragg stated. “They requested readbacks of testimony and asked for video footage to re-watch, as well as written definitions of the law. Their lengthy deliberation – and the totality of the facts and the evidence – underscored why this case was put in front of a jury of Mr. Penny’s peers.”

Penny reacted to the verdict with a smile. Supporters of Neely, however, let their fury be known.

“Racist f—ing country,” one Black Lives Matter supporter yelled as she walked out of the courtroom.  Another enraged Neeler supporter turned to Penny and screamed, “It’s a small world, buddy!”

Penny’s Legal Team Win 

Penny’s legal team had argued that he was justified in protecting his fellow passengers from Neely. They also raised doubts as to whether or not the chokehold is what really killed Neely.

“Who do you want on the next train ride with you?” Steven Raiser, one of Penny’s lawyers, said in his closing statement. “The guy with the earbuds minding his own business who you know would be there for you if something happened? Or perhaps you just hope that someone like Jordan Neely does not enter that train when you are all alone, all alone in a crowd of others frozen with fear?”

Penny’s fellow passengers backed him in this case. One woman who was on the train said she was “scared s–tless” hearing Neely ranting about being “willing to die and go to jail.” She also heard him say “someone is going to die today.”

Another female passenger heard Neely go off on a “satanic” rant.

“Justice has prevailed,” city Councilwoman Joanne Ariola (R-Queens) said after the verdict came in. “Daniel Penny is a hero and I”m happy to see that a good man was not punished for doing the right thing and defending his fellow New Yorkers from a mentally ill criminal who fell between the cracks.”

We’re so glad to see that the right verdict came down in this case. In the end, Penny really is a hero, and he deserves to have all of this put behind him so that he can move on with his life!
