Supreme Court Hears Challenge To Tennessee’s Ban on Transgender Youth Medical Treatments

All eyes are currently on the Supreme Court. Indeed, the highest court in the land is preparing to issue a ruling that could be its biggest one since the overturn of Roe v. Wade.

Transgenderism is one of the biggest hot-button issues in the country right now. In recent years, woke liberals have sickeningly tried to make it easier than ever for minors to receive transgender surgeries.

Last year, the great state of Tennessee fought back against this by banning gender transition surgery for minors. The state also banned puberty blockers and hormone therapy for people under the age of 18. Now, the Supreme Court is about to weigh in after this ban was challenged.

The conservative-majority Supreme Court on Wednesday leaned toward upholding a Tennessee law that restricts gender transition treatments for minors in a significant case on transgender rights.

It did not appear based on a lengthy oral argument that conservative justices believed that the law constitutes a form of sex discrimination that would mean courts have to give it close scrutiny. The court’s three liberal justices all appeared to view the law as classifying people by sex.

The court, which has a 6-3 conservative majority, is considering a challenge brought by the Biden administration and transgender teens and their families against the recently enacted law.

This Ruling Will Have Major Implications Either Way

The Supreme Court ruling on this will be a big one, as over twenty states have passed laws that are similar to Tennessee’s ban. Tennessee is arguing that this ban does not constitute sex discrimination. Instead, the state sees it as a medical regulation that applies to all people.

Multiple Supreme Court justices pointed out that health authorities in Europe have increasingly been raising questions about certain aspects of gender-affirming treatments.

“It strikes me as a pretty heavy yellow light, if not red light, for this court to come in, the nine of us, and to constitutionalize the whole area, when the rest of the world, or at least the people who the countries that have been at the forefront of this, are pumping the brakes on this kind of treatment,” said Justice Brett Kavanaugh, who is a conservative.

The rightwing Chief Justice John Roberts agreed, arguing that Supreme Court justices are “not the best situated to address issues” in which different medical issues need to be weighed against one another.

“Doesn’t that make a stronger case for us to leave those determinations to the legislative bodies rather than trying to determine them for ourselves?” he questioned.

Liberal Justice Responds 

Liberal Justice Sonia Sotomayor appeared to be the most in favor of Biden’s challenge of the ban.

“The evidence is very clear that there are some children who actually need this treatment,” she claimed.

Conservative Justice Samuel Alito, however, wasn’t having any of it. He questioned whether there is sufficient evidence of the efficacy of puberty blockers and hormone treatments. Alito also questioned if being transgender is an “immutable characteristic,” like race.

Adults can do whatever they want to their own bodies. When it comes to children, however, they should not be allowed to have deranged medical procedures that will have irreversible affects on their lives. If children can’t get tattoos when they are under 18, why should they be allowed to mutilate their own bodies with these surgeries?

In the end, we’re glad that the Supreme Court appears to be leaning in Tennessee’s favor when it comes to this ban. Here’s hoping that more states join Tennessee in taking a stand for children!
