For 90 years, Washington demanded that law-abiding Americans ask permission before buying a suppressor – a simple hearing protection device. Fingerprints. Photographs. A $200 tax. Months of waiting. And if the federal government decided you’d jumped through enough hoops, maybe they’d let you exercise your constitutional right. That system is finished. President Trump just directed the ATF to end it, and it’s already done.

The Bureau of Alcohol, Tobacco, Firearms and Explosives announced this week that it will no longer enforce federal approval, registration, or tax-stamp requirements for suppressors, short-barreled rifles, short-barreled shotguns, and “any other weapons” – effective immediately, for every American in all 50 states. Not just for the people who sued. Everyone.

Kansas Attorney General Kris Kobach led the 14-state coalition that fought this battle in court, and he wasn’t shy about what it means:

From Kansas Attorney General Kris Kobach:

“This is a huge victory for firearm owners. Now it’s not just Kansans who can purchase suppressors, short barrel rifles and short barrel shotguns without seeking special permission from the government. It’s for citizens of all 50 states. I’m proud to say that Kansas led the way in delivering this win.”

Kobach didn’t just cheer from the sidelines – his coalition filed suit, argued the constitutional case, and won. That quote isn’t a press release. It’s a victory lap that was earned.

A nine-decade permission slip, finally torn up

Here’s what always made this system so infuriating: it never stopped a single criminal. Criminals don’t file Form 4473, pay their $200 tax, and wait eight months for ATF approval. They never did. The only people the NFA bureaucracy burdened were the hunters, competitive shooters, and ordinary homeowners who played by the rules.

For 90 years, law-abiding Americans were treated as suspects by default – required to prove themselves worthy before Washington would graciously permit them to protect their hearing at the range. Think about that. A permission slip. For hearing protection. In America.

How the dominoes fell

I’ll be honest – it’s rare to see all three branches of government move in the right direction at once. Savor this one. Congress went first. President Trump signed the One Big Beautiful Bill Act, which reduced the NFA making and transfer taxes to zero for the covered items. That single legislative move yanked out the constitutional foundation the entire permission system rested on.

The courts followed. A federal judge in the Northern District of Texas ruled in August that without the tax, the government had no authority to force registration and approval requirements on law-abiding citizens. The case – Silencer Shop Foundation v. ATF – produced a permanent injunction.

Then the executive held the line. Attorney General Todd Blanche’s Justice Department declined to appeal the ruling, then used enforcement discretion to extend the relief beyond the original plaintiffs – to every American, nationwide.

What still applies – and why it matters

A word of practical advice, patriot to patriot: this is a genuine win, not a free-for-all. Background checks, Form 4473, and NICS requirements remain fully in force at licensed dealers. Machine guns and destructive devices stay under the full NFA framework. Your state laws still apply – if your state bans these items, the federal change doesn’t override that.

More importantly, this is enforcement policy – not a permanent act of Congress. A future administration could reverse it. Gun owners should read the actual ATF guidance and know their state laws cold before acting on any of this.

The Founders didn’t write the Second Amendment so Americans could spend eight months petitioning a federal agency for a permission slip. Rights aren’t granted by government – they’re recognized by it. Washington forgot that distinction for nine decades. This week, thanks to President Trump, Kris Kobach’s 14-state coalition, and the gun-rights organizations that bled for this in court, Americans got a piece of that recognition back.

The fight isn’t over. It never really is. But this week, the good guys won.

Key Takeaways

  • President Trump directed the ATF to immediately end the 90-year federal permission system for suppressors and short-barreled firearms.
  • Congress eliminated the NFA tax, courts struck down the registration requirements, and the DOJ extended full relief to all 50 states.
  • Background checks, dealer requirements, state laws, and machine gun regulations remain completely in force.
  • This is enforcement policy, not permanent law – a future administration could reverse it, making the next election critical.
